Part 1: assumption of risks and liability

If you (I or “me”) participate in activities including (but not limited to) breathwork, meditation, personal training, and use of Sauna Mamas’ saunas, ice baths, lounge and changing facilities (collectively, the “activities”),

you agree to all the terms and conditions set forth in this agreement (this “agreement”)

Assumption of risks

1. I am aware and understand that the activities may involve many known and unknown risks, dangers and hazards, including but not limited to the risk of serious injury, death or property damage. I acknowledge that I am voluntarily participating in the activities. I understand that such risks, dangers and hazards cannot be eliminated without jeopardising the essential qualities of the activities.

2. Excluding where Sauna Mamas is at fault, for example where we are negligent, I accept responsibility for the risks, dangers and hazards involved and the possibility of injury, death or property damage when participating in the activities.

3. I understand that I should consult a doctor in advance of performing or participating in any of the activities and that I must advise Sauna Mamas of any health concerns in advance of starting the activities.

4. I understand that Sauna Mamas is not qualified to express an opinion confirming if I am fit to undertake the activities and I understand that I must ensure that I am fit to take part.

5. I understand that I must not take part in any of the activities if I have any pre-existing medical conditions which may make me vulnerable or increase the risks when participating in the activities including but not limited to: high blood pressure, various cardiovascular diseases, pregnancy, multiple sclerosis, severe respiratory conditions, epilepsy, or severe cognitive impairments.

6. I understand I must not take part in the activities if I am under the influence of drugs or alcohol.

Our liability

7. When we will be liable to you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors acting on our behalf; for fraud; or for any legal rights and remedies available to you under UK consumer law.

We will only be liable to you for foreseeable loss and damage that we cause. If we fail to comply with the terms of this agreement, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this agreement or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

8. When we will not be liable you

We shall not be liable for any failure or delay in performing our obligations under this agreement which arises as a result of:

a failure or delay by you in performing any of your obligations under this agreement (including any failure to make any of the service available at all or at the stated time);

anything you do or don’t do which is against the law or causes us harm;

you failing to follow any reasonable instruction of request made by us in relation to the activities;

an event that is beyond our reasonable control. Such events may include the non-available of:of guides, instructors, premises, internet connection and other facilities or services made available by third parties on whom we depend;

our complying with your instructions or requests.

We are not liable for business losses. The services and activities are only supplied to you on the basis that you are a consumer. If you use the services for any commercial or business purpose we will have no liability

to you for any loss of profit, loss of business, business interruption or loss of business opportunity or any liability you may have to a third party.

Other important terms‍

‍9. This agreement constitutes the entire agreement of Sauna Mamas and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter.

10. If any term or provision of this agreement is held to be invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

11. This agreement is binding on and shall ensure to the benefit of Sauna Mamas and me and each of our respective (as applicable) heirs, executors, administrators, successors, and permitted assigns.

12. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

13. The parties hereto have required that this agreement and all documents and notices resulting from it be drawn up in English.

14. Without limiting any of the foregoing, I agree that if I am engaging in or if I engage in the any activities , the program and/or the service in my capacity as an employee, agent, director, officer, or other representative of any entity (including, without limitation, a company, partnership, or trust), I agree that I am authorized to bind such entity, and that, by entering into this agreement, Ii also agree that this agreement shall also be deemed to apply to any claims that such entity may have arising from or relating to the activities and shall function as a release from both (i) me in my individual capacity; and (ii) such entity.

Part 2: additional terms

Eligibility

‍You must be 18 years of age or older to use any of Sauna Mamas’s programs & services. By agreeing to this agreement during the sign-up process, you represent and certify that you are legally able to enter into all purchase and other agreements with Sauna Mamas and its partners, vendors, agents and service providers.

Community Guidelines

‍By joining and participating in Sauna Mamas’s community you are agreeing to the following guidelines.

Privacy

Do not publish your personal information in a public community, whether online or otherwise. Please use direct messaging when personal information must be shared.

Do not take screenshots from Sauna Mamas’s community and post them anywhere without explicit prior written consent from the publisher of the original content.

Do not share private conversations between users that were had with the expectation of remaining private.

‍Personal Belongings

You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the Sauna Mamas facilities. You assume all risk of loss for any of your personal belongings.

Respect

Threatening language, harassment, violence, racism, bullying, attacks on or intimidation of any party, including our community members or staff; malicious speech regarding topics of sexual orientation, gender, gender identity, age, ethnic origin or race, religion, nationality, disability, size, veteran status, marital status, sexist comments; or hate speech will not be tolerated.

Discrimination against people based on race, colour, ethnic origin, religion, disability, gender, gender identity, age, veteran status, marital status, nationality, sexual orientation, or any other characteristics protected under federal or local law will not be tolerated. In short, treat each other respectfully.

Sauna Mamas is a welcoming community where diversity is encouraged to thrive.

Prohibited Behaviour

We want our classes, space and all other Services to be safe and enjoyable environments for all our users. With this in mind, we have established certain behaviour that will not be tolerated while utilizing our Services (Prohibited Behaviour).

While using or taking part in our Services, whether in one of our studios, or at home or some other location, you agree that you shall not.

Wear inappropriate clothing that is unnecessarily revealing, intimidating or that contains messages or images that a reasonable person may find objectionable;

Exhibit nudity, indecent exposure or exhibitionist behaviour of any type. This type of behaviour could result in criminal charges being brought against you;

Play music that can be heard by others taking part in our Services;

Wear clothing that is inappropriate or unsafe for our Services.

Interfere with other users’ enjoyment or participation in our Services;

Interrupt or interfere with our instructors or staff members;

Use our equipment in any manner for which they were not designed or that is not the proper use for the equipment;

The above list is non-exhaustive, and we, and our instructors and staff members, reserve the right, in our sole discretion, acting reasonably, to determine what constitutes Prohibited Behaviour.‍

Additional Health Disclaimer

‍I have read the notice regarding photosensitive seizures below and understand that the program may include video projections and stimulating visuals. I agree to fully assume all such risks and accept personal responsibility for the damages following any such injury.

I agree to conduct myself in a safe and reasonable manner. I agree that I will not participate in the program while under the influence of drugs or alcohol and will not consume drugs or alcohol while participating in the program.

Pregnancy

Unfortunately, if you are pregnant, you would be at risk in the sauna and cold plunge, given the extreme temperatures and fluctuation. Due to the specific nature of the Sauna Mamas classes, we cannot offer expectant mothers to take part in any of our classes or self-cycle sessions. We do not offer any pre-natal treatments currently. Thank you for your cooperation and we look forward to having you back in the future post-pregnancy so that you can enjoy a great experience with us.

THIS PRIVACY POLICY (THIS “POLICY”) DESCRIBES HOW AND WHEN SAUNA MAMAS, USES AND SHARES YOUR INFORMATION WHEN YOU USE OUR WEBSITE AT WWW.SAUNAMAMAS.COM (THE “WEBSITE”), OUR APPS ("APPS"), AND ALL RELATED SOFTWARE, TOOLS, SYSTEMS, SERIES, AND OTHER SERVICES PROVIDED BY US (COLLECTIVELY, TOGETHER WITH THE WEBSITE, OUR “SERVICE”). THIS POLICY ALSO DESCRIBES OUR USE AND DISCLOSURE OF THAT INFORMATION. BY USING OUR SERVICE, YOU CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY.

Personal Information

“Personal Information,” as used in this Policy, is information that specifically identifies an individual end user of the Service, such as an individual's name, address, telephone number, or e-mail address. Personal Information also includes information about an individual’s activities, such as information about his or her activity on our Service, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to Personal Information that identifies that individual.

Aggregate information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed. We may use and disclose aggregate information, and other non-personally identifiable information, for various purposes.

Collection of Voluntarily-Provided Information

We collect Personal Information that our users provide to us in a variety of ways on our Service, including:

E-mail Newsletters: We may offer e-mail newsletters with announcements and information about Sauna Mamas from time to time on our Service. If you sign up to receive a newsletter from us, we collect your e-mail address. You may opt out of receiving e-mail newsletters at any time.

Downloads, User Accounts, and Profiles: Our Service or third parties may give you the ability to download Sauna Mamas software, register for an Sauna Mamas account or to create and update a user profile on the Service. If we offer such functionality on the Service, we will collect the Personal Information that you provide to us in the course of using that functionality. This information may include, for example, your name, contact information, and system information, as well as information about your interests, preferences, and future needs. We may indicate that some personal information is required for you to download our software, register for the account, or create the profile, while some is optional. This information will not be public for other users to see.

Integrated Service: You may be given the option to access or register for the Service through the use of your username and passwords for certain services provided by third parties (each an “Integrated Service”), such as through the use of your Facebook credentials through Facebook Connect. By doing this, you authorize us to access and store the credentials you provide, your name, email address(es), date of birth, gender, current city, profile picture URL, and other information that the Integrated Service makes available to us, and to use and disclose it in accordance with this Policy. You should check your Facebook or other Integrated Service privacy settings to understand and change the information sent to us through Facebook Connect or other Integrated Service. Please review each Integrated Service’s terms of use and privacy policies carefully before using their services and connecting to our Service.

Correspondence: If you contact us by e-mail, using a contact form on the Service, or by mail, fax, or other means, we collect the Personal Information contained within, and associated with, your correspondence. We use this Personal Information to respond to your correspondence. We may also use your correspondence to improve the Service.

Promotions: We or our advertisers and other business partners may conduct or sponsor special contests and other promotions that users may enter or otherwise participate in on our Service. Certain of these promotions may be co-branded with one of our advertisers or other business partners. In these instances, the collection of your Personal Information may occur directly by the third-party partner on its website or other online service and may be shared with us. The promotion will state the privacy policy or policies governing the collection of such personal information.

Our website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages via SMS.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Passive Information Collection

When you visit our Service, some information is collected automatically. For example, when you access our Service, we automatically collect certain information, which may include your browser’s Internet Protocol (IP) address, your browser type, the nature of the device from which you are visiting the Service (e.g., a personal computer or a mobile device), the identifier for any handheld or mobile device that you may be using, the website that you visited immediately prior to accessing any Web-based Service, the actions you take on our Service, and the content, features, and activities that you access and participate in on our Service. We use passively-collected information to administer, operate, and improve the Website and our other services and systems, to improve the effectiveness of advertising on our Service, and to provide advertisements and other content that is tailored to you. If we link or associate any information gathered through passive means with Personal Information, or if applicable laws require us to treat any information gathered through passive means as Personal Information, we treat the combined information as Personal Information under this Policy. Otherwise, we use and disclose information collected by passive means in aggregate form or otherwise in a non-personally identifiable form.

Also, please be aware that third parties, such as companies displaying advertisements on the Service, or sites or services provided by third parties (“Third-Party Sites”) that may be linked to or from the Service, may set cookies on your hard drive or use other means of passively collecting information about your use of their services, Third-Party Sites, or content. We do not have access to, or control over, these third-party means of passive data collection.

Use of Personal Information

We use Personal Information to provide the services and information that you request. We also use your Personal Information to enhance, improve, operate, analyze, and maintain our Service and other systems (e.g., to troubleshoot problems); to prevent fraudulent use of our Service and other systems; to prevent or take action against activities that are, or may be, in violation of our Terms of Service or applicable law; to tailor advertisements, content, and other aspects of your experience on and in connection with the Service; to maintain a record of our dealings with you; for other administrative purposes (e.g., contacting you regarding administrative information or notices); to resolve disputes and enforce our agreements with you; and for any other purposes that we may disclose to you at the point at which we request your Personal Information, and pursuant to your consent. Analytics and Advertising

Sauna Mamas uses third-party analytics and advertising tools to measure traffic and usage trends on our Services and to serve advertisements on our behalf across the internet. These platforms help us better understand which ads bring users to our Services. Disclosure of Personal Information

Except as described in this Policy, we will not disclose your Personal Information that we collect on the Service to third parties without your consent.

Service Providers: We may disclose Personal Information to third-party service providers (e.g., payment processors, data storage, and processing facility vendors) that assist us in our work. We limit the Personal Information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such Personal Information.

Public Areas: Some features on our Service may allow you to upload, post, or otherwise transmit User Content to public areas of the Service, such as content that you post in a public profile on the Service. Please be aware that any Personal Information that you include within any User Content will be made available to other users of the Service. You include Personal Information in User Content at your sole risk. We may allow you to select privacy options that limit access to some types of Personal Information in User Content, but no security measures are impenetrable or perfect. Additionally, even after information posted on the Website is removed, caching and Sauna Mamas hiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Service. We cannot warrant or guarantee that any Personal Information that you provide on and in connection with the Service will not be accessed, viewed, or used by unauthorized persons.

Business Transfers: Information about our users, including Personal Information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which Personal Information is transferred to one or more third parties as one of our business assets.

Legal Requirements: We also disclose Personal Information if we believe that doing so is legally required, or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others, or otherwise to help protect the safety or security of our Service and other users of the Service.

Unsubscribe: If you receive commercial e-mail from us, you may unsubscribe at any time by following the instructions contained within the e-mail or emailing team@saunamamas.com. At any time, you can delete our App from your mobile device. Deleting our App does not delete your account or the related Personal Information. If you wish to delete your account completely, please email us at team@saunamamas.com. Please note that Sauna Mamas' deletion of your Personal Information is subject to limitations, including any applicable legal retention requirements.

Data Deletion: To request permanent removal of your personal data from our servers,  team@saunamamas.com.

Late arrival

If you arrive late, your session will be shortened. If you arrive more than 15 minutes late, we may treat this as a no-show and may reallocate your space.

Cancellations

You may cancel or reschedule free of charge up to 24 hours before your booking time. After that time, bookings are non-refundable.

No-shows

If you do not attend, you will be charged and no refund will be provided.

Exceptions

We may make exceptions at our discretion for genuine emergencies, but we are not obliged to do so.
