Sauna Mamas - Terms of Service

First Part: Assumption of Risks and Liability

If you (I or “me”) participate in activities including (but not limited to) sweat/heat rituals, sound baths, breathwork, meditation, personal development, and use of Sauna Mamas’ sauna/sweat room, ice baths, temperate area, lounge and changing and washing facilities (collectively known as, the “activities”),

you agree to all the terms and conditions set forth in this agreement (henceforth known as “this Agreement”)

Assumption of risks of utilising the Vyner St Bathhouse

1. I am aware and understand that the activities may involve many known and unknown risks, dangers and hazards, including but not limited to the risk of serious injury, death or property damage. I acknowledge that I am voluntarily participating in the activities. I understand that any such risks, dangers and hazards cannot be eliminated without jeopardising the essential qualities of the activities.

2. Excluding where Sauna Mamas is at fault, for example where Sauna Mamas are negligent, I accept responsibility for any risks, dangers and hazards involved and the possibility of injury, death or property damage when participating in the activities.

3. I understand that I should consult a doctor in advance of performing or participating in any of the activities and that I must advise Sauna Mamas of any health concerns in advance of starting the activities.

4. I understand that Sauna Mamas is not qualified to express an opinion confirming if I am fit to undertake the activities and I understand that I must ensure that I am fit to take part.

5. I understand that I must not take part in any of the activities if I have any pre-existing medical conditions which may make me vulnerable or increase the risks when participating in the activities including but not limited to: high blood pressure, various cardiovascular diseases, pregnancy, multiple sclerosis, severe respiratory conditions, epilepsy, or severe cognitive impairments.

6. I understand I must not take part in the activities if I am under the influence of substances classified as illegal under the Misuse of Drugs Act 1971, prescribed medications that cause cognitive impairment, or alcohol.

Our liability

7. When we will be liable to you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors acting on our behalf; for fraud; or for any legal rights and remedies available to you under UK consumer law.

We will only be liable to you for foreseeable loss and damage that we cause. If we fail to comply with the terms of this agreement, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this agreement or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

8. When we will not be liable you

We shall not be liable for any failure or delay in performing our obligations under this agreement which arises as a result of:

a failure or delay by you in performing any of your obligations under this agreement (including any failure to make any of the service available at all or at the stated time);

anything you do or do not do that is against the law or causes us harm;

you failing to follow any reasonable instruction of request made by us in relation to the activities;

an event that is beyond our reasonable control. Such events may include the non-availability of hosts, instructors, premises, internet connection and other facilities or services made available by third parties on whom we depend;

if we comply with your instructions or requests.

We are not liable for business losses. The services and activities are only supplied to you on the basis that you are a consumer. If you use the services for any commercial or business purpose we will have no liability

to you for any loss of profit, loss of business, business interruption or loss of business opportunity or any liability you may have to a third party.

Other important terms‍

‍9. This agreement constitutes the entire agreement of Sauna Mamas and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter.

10. If any term or provision of this agreement is held to be invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

11. This agreement is binding on and shall ensure to the benefit of Sauna Mamas and me and each of our respective (as applicable) heirs, executors, administrators, successors, and permitted assigns.

12. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the

courts of the country you live in. We can claim against you in the courts of the country you live in.

13. The parties hereto have required that this agreement and all documents and notices resulting from it be drawn up in English.

14. Without limiting any of the foregoing, I agree that if I am engaging in or if I engage in the any activities, the program and/or the service in my capacity as an employee, agent, director, officer, or other representative of any entity (including, without limitation, a company, partnership, or trust), I agree that I am authorized to bind such entity, and that, by entering into this agreement, I also agree that this agreement shall also be deemed to apply to any claims that such entity may have arising from or relating to the activities and shall function as a release from both (i) me in my individual capacity; and (ii) such entity.

Second Part: Additional terms

Eligibility

‍You must be 18 years of age or older to use any of Sauna Mamas’ programs & services alone. Individuals under the age of 18 years of age must be accompanied by an adult aged over 21 years of age. No children under the age of 12 years of age are currently able to use our facilities. By agreeing to this agreement during the sign-up process, you represent and certify that you are legally able to enter into all purchase and other agreements with Sauna Mamas and its partners, vendors, agents and service providers.

Community Guidelines

‍By joining and participating in Sauna Mamas’ community you are agreeing to the following guidelines.

Privacy

You are not to risk the exposure of identities of employees, customers, contractors and should ensure that you

do not publish your personal information in a public community, whether online or otherwise. Please use direct messaging when personal information must be shared.

do not take screenshots from Sauna Mamas’ community and post them anywhere without explicit prior written consent from the publisher of the original content.

do not share private conversations between users that were had with the expectation of remaining private.

Personal Belongings

You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the Sauna Mamas facilities provided at the Vyner St Bathhouse or Sauna Mamas Head Office. You assume all risk of loss for any of your personal belongings.

Respect

Threatening language, harassment, violence, racism, bullying, misogynistic references, attacks on or intimidation of any party, including our community members or employees; malicious speech regarding topics of sexual orientation, gender, gender identity, age, ethnic origin, cultural heritage or race, religion, nationality, disability, size, veteran status, marital status, sexist comments; or hate speech will not be tolerated and can result in memberships being rescinded without reimbursement and being escorted off the premises.

Discrimination against people based on race, skin colour, ethnic origin, religion, disability, gender, gender identity, age, veteran status, marital status, nationality, sexual orientation, or any other characteristics that are protected under national or local law will not be tolerated. In short, treat each other respectfully at all times.

Sauna Mamas are a tolerant company, and the Vyner St Bathhouse is a welcoming community where diversity is encouraged to thrive.

Forbidden Behaviours

We want our events, space and all other Services to be both safe and enjoyable environments for all our service users. With this in mind, we have established certain behaviours that will not be tolerated while utilising our Services or attending events (Forbidden Behaviours).

While utilising or taking part in any of our Services or events, whether in the Vyner St Bathhouse or the Sauna Mamas Head Office, you hereby agree that you shall not.

·       Wear inappropriate or objectionable clothing that is unnecessarily revealing, intimidating or that contains text, phrases or images that a reasonable person may find offensive;

·       Exhibit nudity, indecent exposure or exhibitionist behaviour of any kind. This type of behaviour might result in criminal charges being brought against you;

·       Play music, live stream or speak loudly or shout on calls or that can be heard by or interfere with others participating in our Services or events;

·       Wear clothing that is inappropriate or unsafe for use while using our Services or events.

·       Interfere with other customers’ enjoyment or participation in our Services or events;

·       Interrupt or interfere with our instructors or employees;

·       Use our equipment in any way for which they were not designed or that is not the proper or safe use of the said equipment;

Please note that the above list is non-exhaustive, and we, and our instructors and staff members, reserve the right, in our sole discretion, acting reasonably, to determine what constitutes Forbidden Behaviours.‍

Additional Health Disclaimer

‍Occasionally, we may use lighting in a creative way.  We are aware that a small number of service users may be affected by photosensitive seizures/epilepsy.  When agreeing to use the Services and/or attend events at the Vyner St Bathhouse or the Sauna Mamas Head Office I understand and accept that this may include light or video projections and inspiring visuals. I agree to fully assume all such risks and accept personal responsibility for the damages following should any such injury occur.

I agree to act in a safe and sensible manner.

I agree that I will not participate in any of the Services or events if I am under the influence of recreational drugs, medications that cause cognitive impairment, or alcohol and will not consume drugs or alcohol whilst on the premises of the Vyner St Bathhouse or the Sauna Mamas Head Office. Any individual who is found to be in possession of, using, or under the influence of substances classified as illegal under the Misuse of Drugs Act 1971 will be denied entry or removed from the premises. We reserve the right to determine, at our sole discretion, whether an individual appears to be under the influence.  No refunds or compensation will be provided in such circumstances and this may result in your membership being revoked.

Pregnancy

Unfortunately, it is stipulated in current scientific literature that if you are pregnant, you would be at risk in the sauna/sweat room and ice baths, given the exposure to temperature extremes and temperature fluctuations. We do not offer any pre-natal or natal services. For those of you who are pregnant, we wish you a safe and happy pregnancy and look forward to welcoming you into our bathhouse in the future.

Sauna Mamas Attendance, Arrivals and Cancellations

Late arrival

If you arrive late, your session will be shortened – you are not permitted to stay beyond your time slot. If you arrive more than 15 minutes late, we may treat this as a no-show and may reallocate your space.

Cancellations

You may cancel or reschedule your session free of charge up to 24 hours before your booking time.  For Vyner St Sessions or Special events you need to cancel up to 48 hours before the event. After that time, bookings are non-refundable.

No-shows

If you do not attend, you will be charged and no refund will be provided.

Exceptions

We may make exceptions at our discretion for genuine emergencies, but we are not obliged to do so.

Credit usage

Any credits must be used as per the time frames stipulated.  Credits cannot be carried over to the next billing cycle when they will automatically reset.

Privacy Policy

Personal Information

“Personal Information,” as used in this Terms of Service, is information that explicitly identifies an individual end-user of our Services, such as an individual's name, address, telephone number, or e-mail address. Personal Information also includes information about an individual’s activities, such as information about his or her activity on our Service, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to Personal Information that identifies that individual.

Personal Information does not include “aggregate” or other non-personally identifiable information. Aggregate information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed. We may utilise and disclose aggregate information, and other non-personally identifiable information, for various purposes.  We would only do this when there is no risk that any individual could be identified through the aggregate information.

 Information Collection - Provided Voluntarily

Sauna Mamas Ltd take your privacy seriously. Personal Information that our users voluntarily provide to us are collected in various ways, this includes:

E-mail Newsletters: We may send e-mail newsletters with announcements and information about Sauna Mamas or about our Services from time to time. If you sign up, we will need to collect your e-mail address. You may opt out of receiving e-mail newsletters using the Sauna Mamas app and changing your Communication Preferences.  We will not share you email address with any third parties, the software we use is compliant with GDPR regulations.

Downloads, User Accounts, and Profiles: Our Service or third party may give you the ability to download Sauna Mamas software, register for a Sauna Mamas account or to create and update a user profile on the Service. We will collect the Personal Information that you provide to us in the course of using that functionality. Such information may include, your name, contact information (i.e. email and phone number), as well as information about your interests, preferences, accessibility requirements and any current or future needs. Some personal information is mandatory to enable you to download our app, register for the account, or create the profile, while some is optional. This information will not be public for other users to view.

Correspondence: If you contact us using your e-mail, using a contact form on the Service, or by mail (post), fax, or other means, we collect the Personal Information contained within, and associated with, your correspondence. We use this Personal Information to respond to your correspondence. We may also use your correspondence to improve the Service.  This information will not be public for other users to view.

Our website does use cookies which help us to keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send shopping cart reminder messages via SMS.

Information Collection - Passive

When you visit our Service, some information is collected automatically. For example, when you access our Service, we automatically collect certain information, which may include your browser’s Internet Protocol (IP) address, your browser type, the nature of the device from which you are visiting the Service (e.g., a personal computer or a mobile device), the identifier for any handheld or mobile device that you may be using, the website that you visited immediately prior to accessing any Web-based Service, the actions you take on our Service, and the content, features, and activities that you access and participate in on our Service. We also may collect information regarding your interaction with e-mail messages, such as whether you opened, clicked on, or forwarded a message.

We may collect this information passively using technologies such as standard server logs, cookies, and clear GIFs (also known as “Web beacons”). We use passively-collected information to administer, operate, and improve the Website and our other services and systems, to improve the effectiveness of advertising on our Service, and to provide advertisements and other content that is tailored to you. If we link or associate any information gathered through passive means with Personal Information, or if applicable laws require us to treat any information gathered through passive means as Personal Information, we treat the combined information as Personal Information under this Policy. Otherwise, we use and disclose information collected by passive means in aggregate form or otherwise in a non-personally identifiable form.

We do not use or are linked to Third-Party sites. Should we at any time employ third parties, such as companies who wish to advertise on the Sauna Mamas website or app, these third parties may set cookies on your hard drive or use other means of passively collecting information about your access, visitation or use of their services, other Third-Party Sites, or content. We do not have access to, or control over, these third-party means of passive data collection. However, your personal information will not be shared with any Third Parties.

Use of Personal Information

We use Personal Information to provide the services and information that you request. We also use your Personal Information to enhance and improve our services, optimise and analyse our operations and to maintain our Service and other systems (such as  troubleshooting issues); to prevent against the fraudulent use of our Service and other systems; to prevent activities that are or may be in violation of our Terms of Service or against applicable UK law or to take action against such activities; to tailor our content or promotional activities, and other aspects of your experience on and in connection with the Service; to maintain a record of our interactions with you; for other administrative purposes; to resolve and disputes; to enforce any agreements with you; and for any other purposes that we may disclose to you at the point at which we request your Personal Information, and pursuant to your consent. We may also utilise the Personal Information you provide to contact you regarding new products, services, and offers that we believe you may find of interest.

Analytics and Advertising

Sauna Mamas uses third-party analytics and advertising tools to measure traffic and usage tendencies on our platforms. These platforms help us to better understand which types of advertising communication brings users to our Services.

Disclosure of Personal Information

Except as described in this Policy, we will not disclose your Personal Information that we collect on the Service to any third parties without your consent.

Service Providers: We may disclose Personal Information to third-party service providers (e.g., payment processors, data storage, and processing facility vendors) that assist us in our operational duties. We limit the Personal Information provided to these service providers to that which is necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such Personal Information.  Our current third parties comply with General Data Protection Regulation.

Public Areas: Currently, Sauna Mamas Ltd doe not provide public areas on any internet platform. Some future features on our website and app may potentially allow you to upload, post, or otherwise transmit User Content to public areas of our website or app, for example content that you post in a public profile. Please be aware that any Personal Information that you might include within any User Content will be made available to other users of the Service. We actively encourage our service users not to share Personal Information in a way that may put them or others at risk. You include Personal Information in User Content at your own risk.  Future services may allow you to select privacy options that limit access to some types of Personal Information in User Content, but no security measures are infallible. Furthermore, even after information that has been posted on the Website is removed, caching and Sauna Mamas hiving services may have saved that information, and other users or third parties may have copied or stored the information you made available on the Service. Sauna Mamas cannot warrant or guarantee that any Personal Information that you provide on and in connection with the Service will not be accessed, viewed, or used by unauthorised persons or businesses.

Business Transfers: Information about our users, including Personal Information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which Personal Information is transferred to one or more third parties as one of our business assets.

Legal Requirements: We also disclose Personal Information if we believe that doing so is legally required, or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others, or otherwise to help protect the safety or security of our Service and other users of the Service.

Unsubscribe: You may receive promotional e-mail communications or newsletters from Sauna Mamas from time to time, it is your right to unsubscribe at any time by following the instructions contained within the e-mail or by emailing team@saunamamas.com. You can delete the Sauna Mamas App from your mobile device at any time. Deleting our App does not delete your account or the related Personal Information that you may have provided. To delete your account completely, please email us at team@saunamamas.com, so that we can assist you to do this. Please note that Sauna Mamas' deletion of your Personal Information is subject to limitations, including any applicable legal retention requirements.

Data Deletion: To request permanent removal of your personal data from the Sauna Mamas servers,  team@saunamamas.com.

Sauna Mamas Cancellations, Attendance, and Arrivals

Cancellations and No-Shows

You may cancel or reschedule your Quick Fix or Soak sessions free of charge up to 24 hours before your booking time.  There are no refunds for cancelling a booking later than 24 hours prior to the start time. The following penalities will be applied:

• any credit charged, will not be returned

• if you paid by card or quick pay, you will be charged the full amount

  
  

For Vyner St Sessions or Special events you need to cancel up to 48 hours before the event. After that time, bookings are non-refundable. There are no refunds for no-shows or if you cancel a booking later than 48 hours prior to the start time. These are the penalties in both cases:

• if you paid by card or quickpay, you will be charged the full amount

  
  

Ice bath only sessions can be cancelled at any time with no charge or loss of credit.
